Terms of Service
Last updated 27 September 2026
These terms are the agreement for using LocalGap at localgap.io. Each section opens with a short summary to help you find your way; the full text underneath is what counts.
1. Who these terms are between
In short: You, the business using LocalGap, and us.
These terms are an agreement between ALTGRAD GROUP LLC, a New Mexico limited liability company ("LocalGap") (“LocalGap”, “we”, “us”) and the business or person who uses LocalGap (“you”). If you use LocalGap for a company, you confirm that you are allowed to accept these terms for it, and “you” means that company.
By creating an account or using LocalGap, you agree to these terms and to our Privacy Policy, which explains how we handle personal information.
LocalGap uses Google Maps features and content. Your use of them is also subject to the Google Maps/Google Earth Additional Terms of Service (opens in a new tab) and the Google Privacy Policy (opens in a new tab).
2. Business use only
In short: LocalGap is for businesses, and you must be 18 or over.
LocalGap is a business tool. You may only use it for your trade, business or profession, not as a consumer, and you must be at least 18 years old.
Keep your login details secure and your account information accurate. You are responsible for everything done through your account, including by anyone you let use it.
3. Plans, credits and payment
In short: Plans renew monthly until you cancel. Your monthly credits reset each month; credits you buy separately carry over while your subscription is active.
Plans. Our plans, their prices and what they include are on our pricing page. Paid plans are billed monthly in advance through Stripe and renew automatically each month until you cancel. Prices don’t include taxes, which we add where the law requires.
Credits. Some actions use credits, for example receiving leads from a search, finding a business owner’s contact details, AI-written messages, AI edits to a website, importing Google reviews, AI photographs and managed phone calls. The credit cost of each action is shown in LocalGap. Where an action does not deliver, the credits come back automatically: for example, when a search finds fewer businesses than you budgeted for, or an AI edit changes nothing.
Monthly credits. Each paid plan includes a number of credits every month. They reset at each renewal, so unused monthly credits don’t carry over.
Credits you buy. You can buy extra credits at any time. Credits you buy carry over from month to month while your subscription is active, and we use your monthly credits before your bought credits. Without a subscription, bought credits stay in your account until you use them.
Free credits. New accounts receive free credits, as shown when you sign up. We may change or end free credits for new accounts at any time.
Phone calls. Calls placed by LocalGap’s calling provider are charged in credits per answered minute, after the call ends. Calls you place from your own phone through LocalGap are free.
Credits have no cash value. They can’t be exchanged for money, sold or moved to another account.
Price changes. We may change our prices. We will tell you at least 30 days before a new plan price applies to your subscription, and you can cancel before it does.
Failed payments. If a payment fails, we may pause paid features until it is paid.
4. Cancelling and refunds
In short: Cancel any time. You keep your plan until the end of the month you have paid for. Payments aren’t refunded.
You can cancel your subscription at any time from the billing page in your account. Cancelling stops the next renewal. You keep your plan’s features until the end of the period you have paid for, and then your account moves to the free plan. You keep any credits left in your account, but no new monthly credits are added.
Payments are non-refundable. We don’t give refunds for part-used months, unused credits or credits you have bought, except where the law requires it or where we have charged you by mistake. Domain purchases are final (section 10).
5. Acceptable use
In short: Follow the law when you contact people, stop when they ask you to, and don’t misuse LocalGap or its data.
You are responsible for how you use LocalGap and for following the laws that apply to your outreach and your websites. These include anti-spam, telemarketing and data protection laws such as CAN-SPAM and the TCPA in the US, Canada’s anti-spam law (CASL), the UK’s PECR and the GDPR.
You must
- identify yourself truthfully in every message, and include your postal address and a working way to opt out in marketing emails;
- stop contacting anyone who asks you to, promptly, and keep your own do-not-contact list;
- have any consent the law requires before you send texts or make automated or prerecorded calls, and register your texting numbers where carriers require it (such as 10DLC in the US);
- have the right to use any contact data you import into LocalGap.
You must not
- send spam, or messages that are deceptive, harassing or unlawful;
- use LocalGap’s data to decide anyone’s eligibility for credit, insurance, employment or housing, or for anything other than business-to-business prospecting and client work;
- resell, publish or share LocalGap’s data as a list or database, or use it to build a competing product;
- copy, scrape or reverse-engineer LocalGap, get around its limits or security, or overload it;
- publish anything illegal, infringing, misleading or harmful on websites built with LocalGap, or use them for phishing or to impersonate anyone;
- break the terms of the services LocalGap connects to, such as Google’s.
We may suspend or limit your account if you break these rules, or if your use puts LocalGap, our providers or other people at risk.
6. Lead data
In short: Lead data comes from public sources and AI, can be wrong, and is for your own prospecting.
Search results and contact details come from Google Maps, businesses’ websites, public records and other public sources, and some are identified with the help of AI. They can be incomplete, out of date or wrong, and we don’t guarantee their accuracy. Check important details before you rely on them.
You may use lead data, and export it, for your own business prospecting and client work while you have an account. Google Maps content stays subject to Google’s terms.
When you contact someone, or keep their details outside LocalGap, you decide how their information is used and you are responsible for it under data protection law. That includes telling people where you got their details when the law requires it, and honouring their requests. We process your messages and call records for you, on your instructions. If someone asks us to delete their details, we may remove them from your saved lists.
7. Your content and your clients’ websites
In short: Your content stays yours. You are responsible for your websites, your clients and your arrangements with them.
You keep ownership of the content you put into LocalGap, such as text, images, data and websites. You give us permission to store, copy, process and display it only as needed to provide LocalGap, including hosting your websites and showing them to the people you share them with. You confirm that you have the rights and permissions your content needs, including for anything your clients give you.
LocalGap’s templates, design elements and software stay ours. You may use them in websites built and hosted with LocalGap.
Your clients. LocalGap is not a party to your agreements with your clients. You are responsible for those agreements, for supporting your clients, for what is on their websites, and for anything the law requires on them, such as a privacy notice for visitors and consent for any analytics or advertising tools you add.
Enquiries sent through your websites are stored for you and passed on the way you set up. You are responsible for handling them lawfully.
Client forms. When you send a client a form, you are responsible for what you ask and for how you use their answers. Answers and uploads are deleted 90 days after the form closes or expires.
Demo websites are for showing your work to prospective clients. They must not suggest that a business has approved or endorsed you when it hasn’t.
We may remove or disable content that breaks these terms or the law.
8. AI features
In short: AI can make mistakes. Check what it produces before you publish or send it.
LocalGap uses AI to draft messages, edit websites, create images, identify business owners and answer your clients’ questions. AI output can be inaccurate, incomplete or unsuitable, even when it looks right. You are responsible for checking it before you publish or send it, and you must not use AI features to create misleading content, such as fake reviews or false claims about a business.
9. Other companies’ services
In short: LocalGap relies on services run by other companies, whose terms also apply.
LocalGap works with services run by other companies, such as Google, Stripe, Name.com, the mailbox you connect and the apps you link to your websites. Their own terms apply to your use of them, and we are not responsible for them. If a provider changes or withdraws its service, we may need to change or remove the LocalGap feature that depends on it.
10. Domains and hosting
In short: Domains you buy are registered through Name.com in the name you give at checkout, never ours. They renew yearly unless renewal is off, and purchases are final.
Buying a domain
We register the domains you buy through our registrar, Name.com, after your payment has succeeded. A search showing a domain as available is not a promise: if someone else registers it before your order completes, we won’t charge you, or we will refund you in full.
Domains are also subject to the registrar’s registration agreement (opens in a new tab), the rules of the registry that runs the domain ending, and ICANN’s policies, including the Uniform Domain-Name Dispute-Resolution Policy (UDRP). By buying a domain through LocalGap you agree to follow them. ICANN summarises your rights and duties in Registrants’ Benefits and Responsibilities (opens in a new tab).
The price, including our service fee and any taxes, is shown before you pay. Domain purchases are non-refundable once the domain is registered, including when a name was mistyped, so check it before you pay.
Who owns the domain
The legal holder of a domain (the “registrant”) is whoever’s details you enter at checkout. By default that is you; you can enter your client’s details instead if you have their permission. LocalGap is never the registrant of a domain bought for you: we only manage it technically through our account with the registrar.
You must give true, complete and current registrant details and keep them up to date. The registrar may email the registrant to confirm them. If they are not confirmed in time, or turn out to be false, the domain can be suspended or cancelled, and we can’t prevent that.
Renewals
Domains are registered for a year at a time and renew automatically, unless you turned renewal off at checkout or ask us to turn it off by emailing support@localgap.io before we charge you. We charge the card saved with your order about 45 days before the domain expires, so that a failed payment can be sorted out in time. The renewal price is set by the registrar and the registry and can change.
We send renewal reminders about 15 and 7 days before we charge you, through the mailbox you have connected to LocalGap. If you haven’t connected one, we can’t email you, so keep an eye on your domains in LocalGap.
If a renewal charge fails, we try again over about 14 days. If it is still unpaid about 31 days before the domain expires, we turn renewal off. When a domain expires, anything that uses it stops working, including the website we host on it and any email addresses on it. Some expired domains can be recovered for a while, at prices set by the registrar and the registry; after that they are deleted and anyone can register them. We will help you recover a domain while that is possible if you pay the costs, but we are not responsible for a domain lost because its renewal was not paid.
Moving a domain away
You can ask for the transfer code (also called an auth code) for any domain in your account, free of charge, by emailing support@localgap.io. We send it to the account holder within five business days. Registry rules block a transfer for 60 days after a domain is registered or transferred. We won’t hold back a transfer code to make you keep paying for other LocalGap services; we may delay a transfer only where the registrar’s rules allow it, such as suspected fraud or a court order. If you close your account, your domains stay registered to their registrant until they expire, we turn renewal off, and you can still ask for the transfer codes.
You and your clients
Who keeps a domain when you and a client part ways is between you and them. We follow the registrant and account holder on record, and change who controls a domain only when the registrant asks, when the law or a court order requires it, or when a UDRP or registry dispute decision does. If a client contacts us about a domain in your account, we may ask them to contact you.
Hosting websites on domains
You may only connect a domain that you control, or that your client controls and has allowed you to use. We check control with a DNS record before we serve a website on a domain. You are responsible for your domain’s DNS settings. Demo addresses on your own domain are for showing work to prospective clients, and we may limit how many are active at once. We may stop hosting on, or refuse to register, a domain used for anything these terms forbid, or where the registrar, a registry or the law requires it.
Email forwarding addresses
On a domain bought through LocalGap you can set up free email forwarding addresses (such as info@ on that domain) that pass mail on to an inbox you choose. Setting up the first one makes the registrar handle all email for that domain, replacing any other email service on it. You control where a forwarding address points, and can change or remove it, until you remove it or the domain leaves LocalGap — including on a domain registered to your client, so agree with the client where their mail should go. Mail sent to a forwarding address is passed on by the registrar; LocalGap does not receive or store it, and keeps only a record of which address was pointed where, and when.
11. Our rights in LocalGap
LocalGap, including its software, design, templates and brand, belongs to us and our licensors. These terms let you use it while your account is active; they don’t transfer ownership of it. If you send us feedback or ideas, we may use them without owing you anything.
12. Suspending and closing accounts
In short: You can stop any time. We can suspend or close accounts that break these terms.
You can stop using LocalGap at any time, and ask us to close your account by emailing support@localgap.io. Cancel any subscription first (section 4).
We may suspend or close your account if you break these terms, don’t pay, or use LocalGap in a way that creates legal or security risk for us or others. Where it is reasonable, we will tell you first and give you a chance to fix the problem.
When your account closes, your access ends, websites hosted with LocalGap stop being served, and we delete your content as our Privacy Policy describes, so export anything you want to keep before then. Domains are handled as section 10 describes. Sections that by their nature should continue after these terms end, such as 6, 13, 14, 15 and 17, do.
13. Disclaimers
In short: LocalGap is provided as it is. We don’t promise results.
We work to keep LocalGap running well, but we provide it “as is” and “as available”. To the extent the law allows, we don’t promise that it will be uninterrupted, error-free or secure, that its data or AI output will be accurate, or that using it will win you clients or revenue, and we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement.
14. Limits on our liability
In short: Our total liability is capped at what you paid us in the 12 months before a claim.
To the extent the law allows, LocalGap is not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill, arising from these terms or your use of LocalGap, even if we were told they were possible.
Our total liability for all claims relating to these terms or LocalGap is limited to the amount you paid us in the 12 months before the event that led to the claim, or US$100 if that is more.
These limits don’t apply where the law does not allow them to, such as for fraud.
15. Claims about your use
You will defend and compensate LocalGap for claims, losses and costs, including reasonable legal fees, that arise from your content, your websites, your outreach, your dealings with your clients, or your breach of these terms or the law.
16. Changes to LocalGap and these terms
We may change LocalGap and these terms. If a change to these terms materially affects you, we will tell you at least 30 days before it takes effect, in LocalGap or by email. If you keep using LocalGap after that, the new terms apply; if you don’t agree, you can cancel before they take effect.
17. Governing law and disputes
These terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law rules. The state and federal courts located in New Mexico have exclusive jurisdiction over any dispute arising from these terms or LocalGap, and you and we agree to their jurisdiction.
Before starting a claim, please contact us at support@localgap.io so we can try to resolve it informally within 30 days.
18. General
These terms, our Privacy Policy and any terms shown to you when you place an order are the whole agreement between us about LocalGap. If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a right straight away, we can still enforce it later. You may not transfer these terms without our consent; we may transfer them to a successor to our business. We are not responsible for delays or failures caused by events outside our reasonable control. We may send you notices at the email address on your account; send notices to us at support@localgap.io or 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, USA.
